Falmouth Wetherspoons beer garden to go ahead

The Falmouth Wetherspoons Pub is set to get its wish of a beer garden.

In 2017, JD Wetherspoons made plans to build a beer garden on the roof of The Packet Station.

That application was refused in January 2018 by Cornwall Council.

Town planners nineteen47 wrote:

"It is proposed to use the area of land at the rear (north) as a beer garden. No operational development is proposed as removable tables and chairs will be placed on this area in order to provide additional external customer seating."

JD Wetherspoons has gained a Certificate of Lawfulness from Cornwall Council, essentially meaning the proposed works do not require planning permission.

The document reads:

"The submitted Certificate of Lawfulness is concerned only with whether land within the curtilage of The Packet Station, specifically that which is identified on The Location Plan, can lawfully be used as a beer garden.

"Accordingly, the merits of the use of land in question as a beer garden are irrelevant. Similarly, matters relating to amenity issues are irrelevant and do not form any part of the consideration of the application for the Certificate of Lawfulness."
