A pub has failed in its bid to stay open until 2am on Wednesdays after concerns were raised about public nuisance and noise from the venue.

The King's Head in Falmouth had applied to Cornwall Council to amend its licence so that it could remain open until 2am on Wednesday nights. The current licence allows it to stay open until midnight.

Simon Fudge, licensee, told the council's licensing committee that the venue's main nights were on Thursdays, Fridays and Saturdays until a nearby premises started a student night on Wednesdays.

As a result the Kings Head started holding events on Wednesdays using Temporary Event Notices (TENs) for extended opening hours. This had seen the venue increase weekly takings by 10%.

Mr Fudge said that having regular Wednesday events would be a great help for the business and said that in five years there had been no issues with the police.

He explained that the upper floors of the building had been converted into flats which are let to students and that measures had been taken to soundproof the flats.

However environmental protection officer Michelle Cowie told the licensing committee that there had been a complaint about noise from the pub.

She explained that noise recording equipment from the council was installed in the location to monitor the noise levels.

That found that the noise coming from the pub was clearly audible and was causing vibration – she said that this suggested the music from the venue was being played too loudly and with bass frequency levels which were too low.

The pub is in a cumulative impact zone (CIZ) which aims to limit the number of licensed premises in an area to prevent public nuisance.

Ms Cowie said that it was her professional opinion that if the licence to extend the hours was granted it would undermine the licensing objectives in respect to the prevention of public nuisance.

The committee agreed unanimously to refuse the application saying that, listening to all the evidence, they were concerned that if allowed to open until 2am on Wednesday could undermine the licensing objectives.

They were also concerned that as the venue is in the CIZ it could add to problems in the area if the licence was approved.

Mr Fudge was advised that he has the right to appeal the decision through the magistrates' court.
